JOB DESCRIPTION:

Eastman Credit Union is seeking an Account Resolution Assistant. The Account Resolution Assistant is responsible for the control of delinquent loan accounts in order to protect the assets of the Credit Union and minimize losses by performing the following duties:

Essential Duties and Responsibilities

• Collection of all consumer, commercial, credit card, and real estate loans in compliance with state and federal laws and regulations

• Monitor and removal of consumer and Visa lines of credit

• Monitoring and removal of Overdraft Protection Plus for those members who have delinquent credit obligations or at risk to cause loss

• Review and process skip payments for loans requiring Account Resolution overrides

• Assist Account Resolution Manager in reviewing, preparing and completing monthly management reports

• Review and work various daily, weekly and monthly reports related to delinquencies

• Gather, track and record data involving active loans that potentially exceed 30 days in delinquency. Report monthly productivity for team to Asset Recovery Management

• Communicate with member(s) and evaluate personal circumstances, historical account data and credit information; design a realistic repayment agreement to resolve delinquency and prevent loss to ECU

• Defuse potentially adversarial communications with professional courtesy while maintaining excellent member service

• Work with members who qualify for SCRA (Soldier’s Civil Relief Act) benefits. Monitor accounts to ensure ECU maintains compliant with regulatory requirements

• Maintain versatile knowledge of ECU products, services and processes including Member Business Lending, Card Services, Operations, Consumer and Mortgage Lending

• Serve as a resource for ECU personnel on issues related to losses, delinquencies, repossessions, seizures, collection accounts, judgments, charge offs, corrections, late fees, skips, bankruptcy matters, foreclosures, limit removals and ODPP removal

• Work with Asset Recovery Management in developing and maintaining procedures

• Maintain and utilize working knowledge of various bankruptcy laws and provisions; Contact legal counsel representing members to minimize the Credit Union’s losses and expenses, and to promptly secure surrendered chattel; Collaborate with the Credit Union’s Bankruptcy Coordinator to effectively protect the Credit Union’s interests and minimize losses

• Recommending, preparing / authorizing vehicles to be sent for repossession. Submitting repossession orders via web based application. Monitoring loan(s) until default or delinquency is resolved, member redeems vehicle(s) or vehicle is sold at auction. Ensure all statutory and regulatory requirements regarding the repossession have been met

• Responsible for maintaining spreadsheets and databases housing historical data related to repossessions, charge offs, seizures and delinquencies

• Assist Asset Recovery Management in reviewing the delinquency report, recommending accounts for charge off and preparing monthly charge off list

• Perform transactions and file maintenance of charge offs

• Recognize when Financial Counseling, mitigation or extensions are appropriate for the member and solicit the member for the respective service

• Recommend legal action, repossession and foreclosure with appropriate justification after all other available avenues to collect have been exhausted or where circumstances dictate it prudent to do so

• Audit loan payment histories in response to member disputes and make due date corrections and late fee refunds or credit bureau corrections as needed

• Act as a representative on behalf of the Credit Union on an ongoing basis with legal firms, credit bureau agencies, government agencies, repossession agencies, auction companies, and software companies

• Facilitate loan payments for delinquent loans and all payments to charged off loans

• Assist Loss Management staff with preparing documentation for accounts referred for legal action or third party collection agency

• Prepare for testimony and assist legal counsel in federal and/or state court litigation and seizure hearings

• Prepare and represent the Credit Union at seizure hearings involving seized chattel with liens

• Document and update in detail all pertinent information related to collection activity performed in the Temenos Elements collection software

• Effectively utilize all available resources (the Internet, credit bureau report, loan application, etc.) to locate and confirm residence and employment of members

• Processing and posting TEL payments for loans

• Resolve issues compromising the Credit Union’s security as the result of potential storage, towing, garage, and/or mechanical liens; Ensure vendor charges do not exceed amounts allowable by statutes, protecting members and the Credit Union’s interests

• Reverse ACH, DI WEB and TEL payments returned due to NSF, closed accounts, etc.

• Provide recommendations to members for budget counseling, consolidations, loan extensions, payment methods and other items relating to member’s financial needs

  • Computer Skills: Knowledge of CCM, Fiserv, Elements, Accurint, Nautilus, Experian Database software; eTime Payroll systems; Excel, Access Spreadsheet software and Word Processing software, Outlook, Velocity, CUBUS, Misc. credit bureau software, AutoIMS, and other web based miscellaneous software
  • Knowledge of Credit Card Module and how to utilize system to obtain reports, review delinquencies, remove limits, and charge off

Mortgage Loan Originator Functions:

The Business Services Quality Control Coordinator conducts post-closing review of business loans for proper documentation disclosures compliance with credit policy. In addition, this position verifies that the core system accurately reflects loan and account terms. The position also includes various responsibilities that enhance the quality of the business loan portfolio.

 

Essential Duties and Responsibilities:

·          Maintains knowledge of ECU’s business loan policies and credit documentation standards.

·          Maintains knowledge of all regulatory requirements for all business products and audit files in keeping with regulatory compliance requirements.    

·          Audits business loan files to verify the accuracy of loan documents processed during application through funding of loans.  This includes verifying the accuracy of loan documents as they pertain to loan type, amount, interest rate, payment terms, collateral, guarantors, signatures, etc. 

·          Requests outstanding documents and document corrections from appropriate staff and communicates and follows-up proactively third parties as needed.

·          Verifies the receipt of recorded collateral documents to ensure ECU’s lien perfection and title interests are intact.

• Act as steward for all ATM Debit, Debit and Credit plastic. This includes necessary plastic sent to branches equipped with Instant Issue terminals, monthly balancing of plastic on hand, maintaining an adequate supply of card plastics in-house and at our card vendor.

·      Scrutinize all loan applications received from Dealers for funding, assuring it has met ECU’s criteria before buying the loan. Send back to Dealers, loan applications that have not met ECU’s criteria.

·      Audit loan packets for accuracy and completeness to fund loans which are approved by System or Central Underwriters.

·      Complete and verify all income documentation to ensure accurate information is entered and is compliant with decisioned information.

·      Assure ECU retains control of lending process.

JOB DESCRIPTION:

ECU Title & Escrow is seeking a Title Agent Trainee/Title Agent. The Title Agent is responsible for preparing all documentation required to close the real property transaction, ensure all loan closings are conducted within established criteria and guidelines, and travels to closing locations as needed.  Issues related title insurance policies.

 

I.               Position Responsibilities:

 

A.             Documentation Preparation & Analysis

 

a.     Analyze, provide final approval, and sign off on title commitments and title policies.

b.     Prepares ALTA settlement statement in compliance with all lenders, HUD, state, and federal regulatory requirements.

c.     Collects, prepares, analyzes, and/or assembles other documents required for closing including, but not limited to, deeds, powers of attorney, property descriptions, survey and plat descriptions, proof of insurance, confirm and secure payoff information, authorizations from seller and borrower, confirm realtor information, tax information and proof of termite inspection.

d.     Reviews all documents for completeness and accuracy.

e.     Confirm documents convey title appropriately between parties; confirm lien documents are accurate; and works with appropriate parties to resolve any outstanding title issues.

f.      Explain owner’s title insurance and benefits to buyers prior to closing.

 

B.             Scheduling, Communication and Travel

 

a.     Serves as primary contact for members, realtors, lender staff, buyers, sellers, and other interested parties.

b.     Assist parties with information gathering, answering questions, directs parties to the appropriate department/personnel for specialized services.

c.     Review closing documents with appropriate parties by explaining provisions and procedures contained within and answering questions.

d.     Schedule settlement meetings where real estate transactions are closed.

e.     Travel to and from closing locations in the greater Tennessee and Virginia region to conduct closings as needed. 

f.      Prepares lender package and delivers to Closing Agent for ultimate delivery to lender following closing.

g.     Post-Closing:

                                                        i.     Assists Settlement Agents in disbursing closing funds and proceeds in conjunction with lender instructions and closing requirements. Prepare and assemble documents for recording after closing.

                                                       ii.     Closes out files and follows established audit protocols to ensure all documentation is complete and all funds properly disbursed.

                                                      iii.     Responds to member post-closing questions and requests for information.

h.     Provides backup for Closing Agents and staff who are on vacation, sick or are otherwise unavailable as needed. 

 

C.             Other Duties

 

a.     Follow regulations to ensure that all transactions comply with state and federal regulations and rules.

b.     Attend training to remain current with industry standards and regulations.

c.     Actively participates in marketing, community relations activities and civic groups to represent ECUTE.

d.     Must be willing to work flexible hours, including weekend and evening hours, and travel by personal automobile as needed to preform closings in the areas served by ECUTE.

e.     Other duties as assigned.

 

II.              Knowledge and Skills Required:

 

a.    Licensed title agent in Tennessee/Virginia.  Must complete file review with manager prior to advancement from Trainee.  Or may have at least one year experience in a previous title agent position.

b.    State and federal laws and regulations governing the issuance of the title insurance and settlement of real property transactions, including RESPA, RESA (Virginia statute) Truth in Lending, TRID, ECOA and state UCC laws.

c.    Excellent understanding of the field’s concepts, practices, and procedures

d.    Solid understanding of the jurisdictional requirements for performing real property settlement services in all jurisdictions in which ECUTE operates.

e.    Best practices for title companies as designated by ALTA, title insurance underwriters/auditors, and/ or other applicable trade or regulatory authorities.

f.    Excellent Member service skills.

g.    High attention to detail; ability to read and analyze industry-specific, financial, and basic legal documents.

h.    Strong ability to prioritize and manage tight deadlines.

i.      High level of comfort with industry specific software utilized by ECU Title.

j.     Excellent Microsoft Office skills.  

k.    Ability to work independently and exercise judgment, critical thinking and decision making to identify and resolve title issues.
